These Terms of Service ("Terms") govern your use of Elevate Coach, including the marketing site at elevatecoach.app (the "Site") and the Elevate Coach application (the "App"). Elevate Coach is provided by Elevate Sports Labs Inc. ("Elevate Sports Labs," "we," "us," or "our"), a company incorporated in the Province of Ontario, Canada.
By requesting early access, creating an account, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Elevate Coach is a software application that helps coaches and team staff run amateur hockey teams. Features include player evaluation and ratings, tryouts, lineups, game preparation and review, practice plans, a drill and systems library, season planning, team statistics, and ElevateIQ insights.
Elevate Coach works with Elevate Stats, our live game tracking app. You use one account for both. Elevate Coach does not require Elevate Stats: you can also upload game statistics from a CSV file.
We may add, change, or remove features from time to time. We will try to give reasonable notice of material changes, but we do not guarantee the continued availability of any specific feature.
2. Your Account
2.1 Eligibility
You must be at least 16 years old to request early access or create an account. By signing up, you confirm that you meet this minimum age and that the information you provide is accurate.
2.2 Account Security
You are responsible for:
- Keeping your login credentials confidential.
- All activity that happens under your account.
- Notifying us promptly at privacy@elevatesportslabs.com if you suspect unauthorized access.
We are not liable for any loss or damage arising from your failure to protect your account.
2.3 One Account Per User, and Team Invitations
You may not share your account with others or allow another person to use your credentials. The team owner can invite assistant coaches, managers, and other team staff to view the team in the App. Invited people can see everything on the team, including player evaluations and notes, but cannot change anything. You are responsible for who you invite and for removing access when someone leaves the team.
3. Information You Enter
3.1 Your Data
You retain ownership of the team, roster, game, evaluation, and planning data you enter into the App ("Your Data"). By using the App, you grant Elevate Sports Labs a limited licence to host, store, process, back up, and display Your Data for the purpose of providing the App to you and the people you invite, and to generate ElevateIQ insights as described in our Privacy Policy.
3.2 Information About Minors
Amateur hockey teams often include minors. When you enter information about a minor (such as a player's name, jersey number, statistics, ratings, or notes), you confirm that:
- You have the authority to enter that information, whether as the player's coach or team manager, or because you have obtained appropriate consent.
- You will use Elevate Coach only for legitimate team and player development purposes.
- You will treat player ratings and notes as private coaching tools. You will not publish, post, or share them outside your team staff, or use them to publicly rank players.
- You will not share the App or its content in a way that violates the privacy or safety of any minor.
You are solely responsible for ensuring that your use of the App complies with any team, league, or local rules about collecting and handling player information.
3.3 Accuracy
You are responsible for the accuracy of Your Data. We do not review, verify, or correct the information you enter. Player ratings combine game data with your own scores and picks; they reflect your inputs and are not an independent assessment of any player.
4. Acceptable Use
When you use the App, you agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law.
- Enter information about another person (including a minor) without the authority to do so.
- Record health, family, or other sensitive personal details about players in notes or evaluations.
- Attempt to access, probe, or scan any part of the App or its infrastructure outside of normal use.
- Reverse engineer, decompile, or try to extract the source code of the App.
- Use automated scripts, bots, or scrapers to interact with the App or the Site's forms.
- Interfere with or disrupt the App, our servers, or any other user's experience.
- Use the App to harass, threaten, or harm any person.
- Resell, sublicense, or commercially redistribute the App or access to it, except as expressly permitted.
We may suspend or terminate accounts that violate these rules.
5. Early Access, Subscriptions and Payments
5.1 Early Access
Elevate Coach is currently available by invitation only. Requesting early access does not guarantee an invitation, and we decide who is invited and when. Invitations go out in small groups by email. During early access, features may change and some may be incomplete.
5.2 Founding-Coach Offer
The first 50 coaches who accept an early-access invitation and create an account become founding coaches. Founding coaches get:
- Elevate Coach free through the 2026-27 season, until August 31, 2027.
- After that, 30% off the regular Elevate Coach price for as long as their subscription stays active.
The discount applies to one subscription per founding coach and cannot be transferred. If a founding coach cancels, the discount ends with that subscription and does not return if they subscribe again. The founding-coach offer cannot be combined with other offers.
5.3 Paid Plan
Once paid plans launch, Elevate Coach is offered as one paid plan, with no free tier. It is billed monthly or annually in Canadian dollars, as shown at checkout. Every Elevate Coach subscription includes Elevate Stats Pro for the subscriber.
5.4 Billing
Paid subscriptions are processed by Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis for the applicable fee until you cancel. You are responsible for keeping your payment details up to date.
5.5 Renewals and Cancellation
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from the App or by contacting us. When you cancel, you will keep access to paid features until the end of your current billing period.
5.6 Refunds
Subscriptions are non-refundable. Cancelling stops future charges but does not refund the current period.
5.7 Price Changes
We may change our prices from time to time. If we do, we will notify you in advance, and the new price will take effect at your next renewal. If you do not agree, you may cancel before the new price applies. A founding coach's 30% discount applies to the price in effect at each renewal.
6. ElevateIQ (AI Insights)
The App offers ElevateIQ, AI-generated written insights (such as pre-game focus notes, game recaps, player development notes, and roster trends) based on your team's data. These insights are produced by third-party AI service providers and are provided for informational purposes only.
You acknowledge that:
- AI-generated content may contain errors, omissions, or misleading statements.
- Insights are not a substitute for professional coaching judgment, medical advice, or player development guidance.
- Decisions about players, such as roster, lineup, and ice-time decisions, remain yours.
- Elevate Sports Labs makes no warranty as to the accuracy, completeness, or usefulness of AI-generated content.
How we handle data sent to AI providers is described in our Privacy Policy.
7. Game Data from Elevate Stats and CSV Files
Elevate Coach can show games tracked live in Elevate Stats and games you upload from a CSV file. You acknowledge that:
- Statistics are only as accurate as the tracking or file they come from.
- Some features, such as shot maps, need games tracked in Elevate Stats; CSV games carry core numbers only.
- Elevate Stats is governed by its own Terms of Service at elevatestats.app/terms.
8. Service Availability
We work to keep the App available and reliable, but we do not guarantee uninterrupted service. The App may be unavailable from time to time due to maintenance, updates, outages, or circumstances outside our control. Elevate Coach does not work offline and needs an internet connection.
We are not liable for any loss resulting from service interruptions.
9. Our Intellectual Property
Elevate Coach, including its code, design, logos, branding, written content, drill and systems library content provided by us, and AI-generated output (excluding Your Data), is owned by Elevate Sports Labs Inc. or its licensors and is protected by Canadian and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal or internal team use while your account is active and in good standing. All other rights are reserved.
You may not copy, modify, distribute, publicly display, or create derivative works from any part of Elevate Coach without our written permission.
10. Termination
10.1 By You
You may stop using the App at any time. You may request deletion of your account or your early-access request by emailing privacy@elevatesportslabs.com.
10.2 By Us
We may suspend or terminate your account if:
- You breach these Terms.
- Your use of the App creates a legal, security, or operational risk for us or other users.
- We discontinue the App or a specific plan of the App.
If we terminate your account for reasons other than a breach by you, we will give reasonable notice where practical.
10.3 Effect of Termination
On termination, your right to use the App ends. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.
11. Disclaimers
ELEVATE COACH IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATE SPORTS LABS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.
We do not warrant that Elevate Coach will meet your requirements, that it will be error-free, or that any defects will be corrected.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATE SPORTS LABS INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF ELEVATE COACH, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ELEVATE COACH WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Elevate Sports Labs Inc. and its directors, officers, employees, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of:
- Your use of Elevate Coach.
- Your breach of these Terms.
- Your infringement of any third party's rights, including privacy rights of minors whose information you entered into the App without appropriate authority, or ratings and notes you shared outside your team staff.
14. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.
Any dispute arising out of or relating to these Terms or Elevate Coach will be resolved in the courts of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top will show when they were last revised. If we make material changes, we will notify you in the App, by email, or through the Site.
Continuing to use Elevate Coach after an update means you accept the revised Terms. If you do not agree, you must stop using the App.
16. General
- Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and Elevate Sports Labs Inc. regarding Elevate Coach.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
